Definitions:

Supplier means The Little Marionette
-
Customer means the person, firm or company who purchases the Goods and any Services from the Company.

Goods and Services means The Breville Bambino 12-month coffee subscription which includes one (1) Breville Bambino machine and a monthly delivery of 1 kg of The Little Marionette Coffee over 12 months.

- Agreement. The Customer applies to the Supplier for the Goods and Services contract, and the Supplier reserves the right to approve or not approve the Customer.
- Eligibility: The Breville Bambino 12-month coffee subscription is;
- Only available to approved applicants;
- Only available to Australian residents; and

Is limited to one (1) machine per household.

Inclusions: This subscription includes one (1) Breville Bambino machine and a monthly delivery of 1 kg of The Little Marionette Coffee over 12 months. Once the 12-month subscription is up the Breville Bambino becomes the property of the customer.

Coffee: The Breville Bambino subscription includes a monthly 1kg delivery (12 in total) of The Little Marionette roasted coffee. The customer can choose between Sanchez, House and Legs Eleven blend (subject to availability).

Cost: The cost of the Breville Bambino machine and 1 kg coffee is included in the monthly subscription fee of $80. The total cost for the 12-month subscription is $960 (incl. GST). Once a Customer signs up for this subscription, they will receive as soon as reasonably practicable the Breville Bambino together with the first 1kg of coffee. If the customer chooses to pay the early termination fee prior to the conclusion of the 12-month subscription, the supply of coffee will be terminated upon notification from the customer. If not terminated, the supply of coffee will continue at a reduced rate of $40 per month.

Payment: A Direct Debit payment of $80 per month over a 12-month period will be processed through PayPal or Stripe against the nominated credit card. The total cost for the 12-month subscription is $960 (incl. GST). [After the 12 months period concludes, the 1 kg coffee will automatically continue to be supplied monthly at a rate of $40 per month, until either party notifies the other the supply agreement is at an end in which case the agreement will finish at the end of that month]. A $5 administration fee will be charged for each occurrence of a rejected transaction which may include insufficient funds or expired card details.

Termination: If the subscription is terminated before the 12-month period is up, an early termination fee of $450 (incl. GST) will be charged. The Breville Bambino remains the property of The Supplier until the full subscription is paid or the early termination fee is paid at which point ownership will transfer to the customer.

Exclusion clause. The Customer warrants that it has not relied on any representation by the Supplier other than what is in these Terms and Conditions.

Title. Title in the Breville Bambino machine shall remain with the Supplier until the Customer has paid and discharged any and all monies owing for the 12 months subscription, or the agreement is terminated early and the early termination fee is paid. The Customer cannot encumber the Breville Bambino machine until title passes to the Customer in accordance with this Agreement.

Bailment. The Customer acknowledges that it is in possession of the Breville Bambino machine solely as Bailee until title passes to the Customer in accordance with this Agreement. If the contract is terminated before title passes to the Customer, the Supplier has right to repossess the Breville Bambino machine.

No on-sale. The Customer cannot on-sell the Goods and Services unless approved in writing by the Supplier.

Personal Property Securities Act (“PPSA”). The Supplier can register their interest in the Breville Bambino machine on the Personal Property Security Register.

Privacy. The Customer agrees the Supplier can collect, retain, record, use and disclose personal information about the Customer, in accordance with the Privacy Act 1988, to persons and/or legal entities in order to protect the Supplier's interest under this agreement.

Non-Excludable Rights. The Customer's rights under the Australian Consumer Law Schedule of the Competition and Consumer Act 2010 are expressly preserved and are not excluded by any clause or term to the contrary.

Disclaimer of Liability. The Customer's rights are limited to those rights and remedies in the Non-Excludable Rights.

Force Majeure. The Supplier will have no liability to the Customer in relation to any loss, damage or expense caused by the Supplier’s failure to deliver the Goods as a result of any matter beyond the Supplier’s control.

Alternative Goods and Services where Goods and Services no longer available. The Supplier may in their absolute discretion supply an alternate Good or Goods. In this event, the Supplier will supply replacement goods equal to or better than the original Good(s).
